1. Who we are and what you are agreeing to
SHORT LOANS NG LLC, a Missouri limited liability company with its principal office at 301 Westwood Ave, Columbia, MO 65203-2869, operates the Loans NG mobile application for iOS, the website at shortloansng.com, and the related loan-matching service. In these Platform Terms we refer to that company as “we,” “us,” or “the company,” and to the application, the website and the service together as “the app.” When we say “you,” we mean the individual person who downloads, opens, registers for, or otherwise interacts with the app.
By downloading the app, creating an account, submitting an application, or by continuing to use the website or the service in any other way, you confirm that you have read these Platform Terms and our data handling policy, that you understand them, and that you agree to be bound by them. If any part of this agreement is unacceptable to you, please stop using the app.
Loans NG is a marketplace, not a lender. We connect consumers with independent third-party lenders and financial service providers. We do not originate loans, and we do not make credit decisions. Every offer that appears in the app, every interest rate, every repayment schedule, and every funding decision belongs to the lender that issues it.
2. Loan terms inside the network
The lenders we work with offer personal loans and short-term cash advances in the range of fifty US dollars to five thousand US dollars, with annual percentage rates that vary from approximately four percent up to thirty-five point nine nine percent, and with repayment durations from roughly seventy days to thirty-six months. Those ranges describe the network as a whole. The specific amount, APR, term, payment frequency, and any origination, late, or returned-payment fee that you receive are determined exclusively by the lender that approves your application, based on its own underwriting standards, your creditworthiness, the state in which you live, and the laws that apply there. State usury caps and consumer protection statutes can reduce the upper bound considerably; for example, certain states cap personal loan APR well below the upper end of our network range.
You will always see the lender’s formal cost disclosure — typically a Truth-in-Lending Act disclosure or its equivalent — before you accept any offer. That document spells out the APR, the finance charge, the total of payments, the payment schedule, and any applicable fees in standardized form. Read it carefully. Once you accept an offer, the loan agreement is between you and the lender, not between you and us, and that agreement controls.
Repayments are usually pulled from the bank account you provided, by ACH debit, on the schedule the lender selects. You are responsible for keeping enough money available on each due date so that the lender does not need to charge a returned-payment fee or a late fee. Most lenders in our network allow you to repay early without a prepayment penalty, but you should confirm that in your specific agreement.
3. Eligibility
To use the app you must be at least eighteen years old, or older if your state of residence sets the age of majority above eighteen. You must be a lawful resident of the United States, must have the mental and legal capacity to enter into binding contracts, and must hold a valid Social Security number or Individual Taxpayer Identification Number. You must maintain an active checking account in your own name at a US financial institution, you must have a verifiable source of income, and you must use the app only for lawful, personal, non-commercial purposes. The information you submit must be truthful, current, and complete. Submitting fabricated, borrowed, or otherwise inaccurate information is a material breach of this agreement and may be reported to fraud prevention services and to law enforcement.
4. Authorization to collect and share your data
This is the most important section of these Platform Terms because it describes what actually happens to the information you give us. By creating an account and submitting an application, you expressly authorize SHORT LOANS NG LLC to collect, store, process, and disclose the personal and financial information you provide, in the ways described both here and in our data handling policy. The categories of information we work with include your full legal name, your date of birth, your residential address with ZIP code, your email address, your mobile and any home phone numbers, your Social Security number or ITIN, the number and issuing state of your driver’s license or other government identification, your full bank account number and bank routing number along with the bank’s name and the type of account, your employer’s name and phone number, your employment status and job title, your monthly or annual gross income, the source of that income, and the purpose for which you are seeking a loan or cash advance.
You authorize us to transmit that information to one or more licensed third-party lenders, financial institutions, marketing partners, data aggregators, and other recipients within our network, so that they can evaluate your eligibility, generate a pre-qualification offer, complete final underwriting, set up disbursement and repayment, and otherwise carry out the matching service. You acknowledge that under the California Consumer Privacy Act, as amended by the California Privacy Rights Act, that transfer can constitute a “sale” or “sharing” of personal information, because we receive valuable consideration — typically in the form of a referral fee, a marketing fee, or a per-funded-loan payment — from the lenders or partners that receive it. You also authorize the recipients of your information to contact you in connection with potential offers, subject to your separately given marketing consents and the rules of the Telephone Consumer Protection Act.
You can withdraw your authorization for future data sharing at any time by sending us a “Do Not Sell My Information” request at support@shortloansng.com. We will process that request within fifteen business days. Information that has already been transferred to a lender or partner cannot be recalled, and any further use of it is governed by that recipient’s privacy practices.
5. What the app does and does not do
The app helps you compile a single, structured loan-application profile and then surfaces pre-qualification offers from third-party lenders that may want to work with you. We display those offers, we explain what each one represents, and we give you the tools to accept or decline. We do not lend money. We do not set, negotiate, or guarantee any APR, fee, term, or amount. We do not make credit decisions or pre-approve anyone. We do not move funds between bank accounts; only your lender, with your authorization, does that. Once you accept a lender’s offer, the agreement is between you and the lender, and SHORT LOANS NG LLC is not a party to it.
6. Your account
Some features of the app require you to register an account. Your account, your password, your one-time codes, and any biometric session you authorize are personal to you. Keep them confidential. You are responsible for everything that happens through your account, even if someone else gets access to it. If you suspect unauthorized use, please notify us promptly at support@shortloansng.com. We may, at our sole discretion, verify your identity at any point during your use of the app, and we may suspend, restrict, or close an account if we reasonably suspect fraud, misuse, or breach of these Terms.
7. Electronic communications
By using the app you agree that we may communicate with you electronically — through email, push notifications, in-app messages, and SMS for things like one-time passcodes and application status — and that we may deliver legal notices, disclosures, and agreements electronically. Under the federal Electronic Signatures in Global and National Commerce Act and corresponding state laws, electronic records and electronic signatures have the same legal effect as paper documents and ink signatures. If you ever want to receive something on paper, write to us at support@shortloansng.com and we will discuss the options. Withdrawing consent to electronic communications may make some features of the app unavailable.
Marketing-style messages — calls, texts, or emails about promotional offers — are a separate consent. You do not need to agree to receive them in order to apply for a loan, and you can opt out of them at any time without affecting the transactional notifications you actually need.
8. Fees and our compensation
Loans NG is free to download and free to use as a consumer. SHORT LOANS NG LLC does not charge you anything to fill out the application, to view offers, or to use the app. Our revenue comes from the lenders and partners in our network, who pay us a referral fee, a marketing fee, a per-lead fee, or, in some cases, a percentage of a funded loan when a borrower they connected with through the app takes out a product. This compensation may influence the order in which offers appear inside the app, but it does not change the substantive terms — APR, fees, schedule — of any specific lender’s offer; those are set by the lender under applicable law. We will identify lender-paid placements where the law requires it.
9. Acceptable use
You agree to use the app only for lawful purposes and consistent with these Platform Terms. You will not use the app for fraud, money laundering, or any unlawful financial activity, you will not submit information that you know to be false or misleading, you will not interfere with or attempt to bypass the app’s security, you will not run scrapers, bots, or other automated tools against the service without our written permission, you will not introduce malware, you will not reverse engineer or decompile the app except where applicable law specifically allows it, you will not copy or redistribute parts of the app or its content without permission, you will not impersonate another person, and you will not use the app to harass anyone working on it or working for our network partners. Violations may lead to immediate account closure and to civil or criminal liability.
10. Third-party lenders and links
The app surfaces information from independent third parties — lenders, financial institutions, identity verification vendors, marketing partners, and ratings sources — and may include links into their websites or apps. These third parties operate under their own terms, their own privacy practices, their own pricing, and their own state-by-state licensing. We do our reasonable best to work with reputable partners, but we are not responsible for what they do or for what happens once you leave the app. Read each lender’s loan agreement and privacy notice before you sign anything.
11. Intellectual property
SHORT LOANS NG LLC, or its licensors, owns the app, the brand, the website, the source code, the visual design, the illustrations, the logo, the copy, and the data compilations behind the service, all of which are protected by US copyright, trademark, and other intellectual-property laws. We grant you a limited, personal, revocable, non-exclusive, non-transferable license to use the app for your own non-commercial purposes, in accordance with these Terms. Any other use — copying, distributing, modifying, scraping, sublicensing, or building derivative products — requires our written permission.
12. Feedback
If you send us suggestions, comments, ideas, or other feedback about the app, we are grateful — and you are giving SHORT LOANS NG LLC a worldwide, royalty-free, perpetual, irrevocable license to use that feedback in any way we see fit, including building it into the product, without owing you payment or attribution. You confirm that the feedback you send is yours to give and does not violate anyone else’s rights.
13. Disclaimers
The app and everything in it is provided on an “as is” and “as available” basis. To the fullest extent allowed by applicable law, SHORT LOANS NG LLC disclaims all warranties of any kind, whether express, implied, or statutory, including without limitation any warranty of merchantability, fitness for a particular purpose, non-infringement, or any warranty arising out of course of dealing or usage of trade. We do not warrant that the app will be uninterrupted, timely, secure, or free of errors, that any defects will be corrected, or that the app will meet your expectations. Use of the app is at your own risk.
SHORT LOANS NG LLC is not a lender and does not make credit decisions. Loan approval, denial, APR, fees, and funding speed are determined solely by the third-party lender, are not under our control, and are not guaranteed.
14. Limitation of liability
To the maximum extent allowed by applicable law, neither SHORT LOANS NG LLC nor its members, officers, employees, agents, partners, or licensors will be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profit, revenue, savings, data, goodwill, or other intangible loss, that arises out of or relates in any way to your use of, or your inability to use, the app or to the conduct of any third-party lender or partner. This limitation applies even if we have been told that those damages might happen.
If, despite the above, a court of competent jurisdiction finds SHORT LOANS NG LLC liable to you for anything related to these Terms or the app, our total cumulative liability to you for all claims combined will not exceed one hundred US dollars. Some states do not allow certain limitations of liability; if you live in one of them, parts of this section may not apply to you.
15. Indemnification
You agree to defend, indemnify, and hold harmless SHORT LOANS NG LLC and its members, officers, employees, agents, partners, and licensors from and against any claims, demands, losses, costs, damages, liabilities, and reasonable attorneys’ fees that arise out of or relate to your use of the app, your breach of these Terms, your violation of any applicable law or regulation, or your infringement of someone else’s rights.
16. Governing law and dispute resolution
These Platform Terms are governed by, and interpreted in accordance with, the laws of the State of Missouri, without regard to its conflict-of-law principles, together with applicable federal law. Before either of us starts a formal proceeding, we both agree to try to resolve a dispute informally. To start that process you must send a written notice to support@shortloansng.com that describes the dispute, the relief you want, and your contact details. We will work in good faith for thirty days to resolve the matter. If we cannot, the dispute will be settled by final and binding individual arbitration under the Federal Arbitration Act, conducted by a neutral arbitrator under the consumer rules of a recognized arbitration provider; the arbitrator may not consolidate more than one person’s claims, and class or representative arbitration is not permitted. You and we both waive the right to a jury trial and the right to participate in a class action. The only exceptions are claims for injunctive relief related to intellectual property, which may be brought in the state or federal courts located in Missouri, and any claim that applicable law expressly carves out from arbitration; you consent to the personal jurisdiction of those courts for those claims.
17. Service availability
We may add features, change features, remove features, suspend the app for maintenance, or take it offline entirely, at any time and without notice. We are not liable for any inconvenience or loss you experience because the app is unavailable.
18. Suspension and termination
We may suspend or terminate your access to the app, including any account you have, at our sole discretion, with or without notice, if we reasonably believe that you have breached these Terms, that your use of the app is harmful to us, our partners, or other users, or that suspension or termination is required by law. You may stop using the app at any time by uninstalling it and, if applicable, asking us to close your account. Provisions that by their nature should survive termination — including the sections on intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution — continue to apply.
19. Changes to these Terms
We may update these Platform Terms over time. When we do, we will revise the effective date at the top of this page and, for material changes, will provide additional notice through the app or by email. Your continued use of the app after revised Terms become effective is your acceptance of them. If you don’t accept a change, please stop using the app.
20. Apple-specific terms
The Loans NG iOS app is distributed through the Apple App Store. These Platform Terms are between you and SHORT LOANS NG LLC only — they are not an agreement with Apple Inc. Apple is not responsible for the app or for any claims relating to it, including product liability claims, claims that the app fails to comply with any legal or regulatory requirement, and claims arising under consumer protection or privacy law. Apple has no obligation to provide any maintenance or support for the app. If a third party claims that the app or your possession and use of it infringes their intellectual property rights, SHORT LOANS NG LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms Apple has the right to enforce them against you. Your use of the app must comply with the App Store Terms of Service and the usage rules in the Apple Media Services Terms and Conditions.
